Terms and Conditions

Effective January 1, 2026

R&C Midland Concrete Construction, midlandconcreteconstruction.com, team@midlandconcreteconstruction.com

Agreeing to these terms

These terms cover your use of this website and any work you ask R&C Midland Concrete Construction to do. When you browse the site, request an estimate or schedule a job with us, you agree to them. If you don't agree, please don't use the site or book work through it.

If you and our company sign a written estimate, proposal or contract for a specific job, that document controls wherever it differs from these terms. These terms fill in anything it doesn't address.

What we do

R&C Midland Concrete Construction is a concrete contractor in Midland, TX. We build driveways, patios, sidewalks, slabs, foundations and other concrete work for homes and businesses in Midland and the cities around it. You can see the full list on our home page and read more about our company on our about page.

Descriptions on this website are general. The exact work on your property, including the size, thickness, finish and materials, is whatever your written estimate or contract states.

Estimates and pricing

We give free in-person estimates with no obligation to hire us. We price an estimate from what we can see and measure on the day we visit, so it reflects the site conditions we can see then.

Some conditions only show up once the old concrete is out or the ground is dug, such as soft or unstable subgrade, which is the soil the slab sits on, buried debris, roots or utility lines. If we find something like that, we'll stop, show you what we found and explain the cost before doing extra work. We won't charge for added work you haven't approved.

Unless your estimate says otherwise, it's good for the period written on it. After that, material prices can change, so we may need to update the figure before scheduling.

Scheduling, weather and cancellation

We'll give you a planned start date once you accept the estimate. Concrete depends on the weather, so rain, high wind, freezing temperatures or extreme heat can push a pour back, because pouring in bad conditions leads to a weaker slab. Delays from weather, material supply or other causes outside our control are not a breach of our agreement, and we'll reschedule with you as soon as conditions allow.

Please clear the work area of vehicles, furniture and other items before we arrive, and keep people, pets and vehicles off fresh concrete for the curing time we give you. Curing is the waiting period while the concrete hardens and gains strength, and using it too early can damage the surface.

If you need to cancel or move your date, call us at (432) 219-6562 as early as you can. If we've already ordered materials, formed the job or scheduled a concrete delivery, you may be responsible for those costs, as stated in your estimate or contract.

Payment

Payment terms, including any deposit and when the balance is due, are written on your estimate or contract. On larger jobs we may ask for a deposit before ordering materials, and we'll tell you that up front.

Balances not paid when due may be subject to the collection rights Texas law gives contractors, including lien rights on the improved property. We'd much rather sort out any billing question by talking it through, so please call us if something on your invoice doesn't look right.

What concrete can and can't promise

Concrete is a natural material, and some things about it are normal and not defects. Small hairline cracks, slight color differences between pours and minor surface variation can happen even on well-built work. We cut control joints, which are planned grooves in the slab, to guide where cracking happens, but no contractor can promise a slab will never crack.

Our work is backed by our satisfaction guarantee, and any written warranty we give you is described in your contract. Apart from what's written there, we make no other promises, stated or implied, about the work or this website, to the extent Texas law allows.

Any warranty doesn't cover damage from things outside our control, such as soil movement, tree roots, heavy loads beyond what the slab was built for, deicing chemicals, poor drainage you change after the job, lack of care during curing, or work done by others.

Limits on our liability

We're licensed and fully insured, and we stand behind the work we do. Still, to the extent Texas law allows, R&C Midland Concrete Construction is not liable for indirect, incidental or consequential losses, such as lost use of your property, lost income or similar costs that follow from a job or from using this website.

Where we are found liable, our total liability is limited to the amount you paid us for the work in question. Nothing in these terms limits any right you have that Texas law doesn't allow a contractor to limit.

Using this website

The information on this site is general and meant to help you understand concrete work. It isn't engineering, legal or permit advice for your property, and it may not reflect every local rule. We try to keep it accurate, but we don't guarantee it's complete or current.

The text, photos and design of this site belong to R&C Midland Concrete Construction. Please don't copy or reuse them without our permission.

If we disagree

If you're unhappy with any part of our work or these terms, contact us first so we can look at it with you and try to make it right. Most problems get solved with a conversation and a visit to the site.

If we can't resolve it that way, we both agree to try mediation in good faith before going to court. Any lawsuit that follows will be brought in the state or county courts that serve Midland County, Texas.

Governing law

These terms, your use of this website and any work we do for you are governed by the laws of the State of Texas, without regard to rules that would apply another state's law.

Changes to these terms

We may update these terms from time to time. The version posted on this page applies from the day it's posted. Changes won't affect a job already covered by a signed estimate or contract unless we both agree in writing.
